Important: These Terms constitute a legally binding agreement between you and FirstPassPA LLC. By using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
By accessing or using FirstPassPA (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and FirstPassPA LLC, a Michigan limited liability company ("Company," "we," "us," or "our").
You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that you are at least 18 years old.
FirstPassPA is an educational platform designed to assist physician assistant students and healthcare professionals in preparing for the Physician Assistant National Certifying Examination (PANCE) and related assessments. The Platform provides:

We are NOT affiliated with, endorsed by, sponsored by, or approved by the National Commission on Certification of Physician Assistants (NCCPA) or the Physician Assistant Education Association (PAEA). PANCE® and PANRE® are registered trademarks of NCCPA; End of Rotation™ is a program of PAEA. All other product names, logos, and brands referenced on this site are trademarks of their respective owners and are used for identification purposes only; such use does not imply affiliation or endorsement. Clinical information presented on the Platform is intended solely for examination preparation purposes. Medical knowledge evolves continuously — always defer to your clinical supervisors, program curriculum, institutional policies, and current evidence-based clinical guidelines in actual patient care situations.
FirstPassPA LLC makes no representation, warranty, or guarantee — express or implied — that use of this Platform will result in passing any examination. Individual results vary significantly based on prior knowledge, study habits, time invested, and other factors entirely outside our control. Our "Pass Guarantee" (Section 5.4) is a limited, conditional refund-or-extension remedy — it is not a guarantee or promise that you will pass any examination.
To access certain features of the Platform, you must create an account. You agree to:
One account per person. You may not create multiple accounts or share your account credentials with others. We reserve the right to terminate accounts that violate this policy without refund.
Free users receive access to ten (10) practice questions per day. Free access resets at midnight local time.
Paid subscribers receive unlimited access to all Platform features including unlimited questions, flashcards, timed examinations, AI tutor, and analytics. Pro subscriptions are available on a monthly or annual basis at the rates published on the Platform at the time of purchase.
Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected). Payment is processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred.
All purchases are final, and we do not offer refunds, credits, or exchanges for dissatisfaction with the Platform, change of mind, or unused subscription time — except as expressly provided under our Pass Guarantee below.
Pass Guarantee. Annual-plan members who meet the eligibility and usage conditions and provide an official NCCPA score report showing a non-passing first attempt may request a free extension of access or a refund of their annual subscription, subject to the full terms at firstpasspa.com/pass-guarantee. The Pass Guarantee applies only to the annual plan; monthly subscriptions are non-refundable.
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. You will retain Pro access through the end of the paid period.
We reserve the right to change subscription prices at any time. We will provide at least 30 days notice of any price increases. Continued use of the Platform after a price change constitutes acceptance of the new pricing.
Physician assistant education programs may purchase institutional licenses covering a defined number of student seats ("Program Seats") under a separate written agreement between the Company and the institution (the "Program Agreement"). If your Platform access is provided through a Program Seat, this Section 5.7 applies to you in addition to the rest of these Terms.
Faculty visibility is a condition of every Program Seat. While your Program Seat is active, authorized faculty and administrators of your program may view your Platform performance and usage data, including your practice-question accuracy and trends, performance by content area, engagement and activity history (such as question volume and last-active date), risk indicators derived from that data, and notes recorded by program faculty about study interventions. This visibility cannot be disabled for an active Program Seat. We notify you by email and in the Platform when a Program Seat is activated for your account.
If you do not wish to share this data with your program, you may decline or request removal of your Program Seat by contacting your program or support@firstpasspa.com; you may instead use the free tier or purchase an individual subscription, neither of which grants your program visibility into your account.
Program visibility is limited to the data described above: program faculty do not receive your account credentials, private account settings, or billing information. Where your performance data is maintained for your program, we handle it as a service provider to the institution consistent with the Program Agreement and applicable education-privacy law (including FERPA where it applies), and we do not sell it or use it for advertising.
Program Seat access ends when the Program Agreement expires or terminates, or when your program removes your seat. When a Program Seat ends, faculty visibility ends with it; your account and personal study history remain yours, and you may continue on the free tier or an individual subscription. If your account was linked to a Program Seat in error (for example, a mistyped roster email), contact us and we will unlink it promptly.
All content on the Platform — including but not limited to questions, explanations, mnemonics, flashcards, software, design, graphics, and text — is owned by FirstPassPA LLC or its licensors and is protected by United States and international intellectual property laws.
You may not:

We are not responsible for the practices, content, or availability of any third-party services.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
We do not warrant that: (a) the Platform will be uninterrupted or error-free; (b) any content is accurate, complete, or current; (c) the Platform is free of viruses or other harmful components; or (d) use of the Platform will result in any particular outcome on any examination.
TO THE FULLEST EXTENT PERMITTED BY MICHIGAN LAW, FIRSTPASSPA LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
Our total liability to you for any claims arising from your use of the Platform shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless FirstPassPA LLC and its members, officers, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Platform.
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the Platform shall first be submitted to good-faith negotiation. If negotiation fails within 30 days, disputes shall be resolved by binding arbitration in Michigan under the rules of the American Arbitration Association. You waive your right to participate in any class action lawsuit or class-wide arbitration.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
We reserve the right to suspend or terminate your account at any time for violation of these Terms, without notice and without refund. You may terminate your account at any time by contacting us. Sections 3, 6, 9, 10, 11, and 12 survive termination.
